Bay Area town enacts total and complete tobacco ban
The town of Tiburon in Marin County has made national news (as of November 2025 by passing the most comprehensive tobacco and nicotine sales ban in the country. Approved unanimously by the town council, the ordinance eliminates the sale and delivery of all tobacco and nicotine products—including cigarettes, cigars, vapes, and e-smoking devices. Tiburon officials say the town’s lack of existing tobacco retailers made it an ideal place to implement stronger protections for youth and residents.
Local youth advocates played a powerful role in shaping the policy. Students from Marin County’s Youth Action Committee spoke at multiple council meetings, emphasizing the urgent need to protect young people from addiction and praising the council for taking their concerns seriously. Only one industry group submitted opposition, while community support remained strong throughout the process.
Tiburon now joins cities like Manhattan Beach and Beverly Hills in adopting bold tobacco control measures, but goes even further with additional protections. The ordinance requires landlords to include anti-smoking clauses in leases for multi-unit housing and allows residents to take civil action against repeat violators. Penalties range from $250 to $1,000 per incident. With fewer than 9,000 residents, Tiburon is setting a powerful example for what strong local leadership can accomplish.
